Humanitarian and Compassionate Cases

Section 25 of IRPA (Immigration and Refugee Protection Act) permits individuals to apply for permanent residence in Canada, based on their special circumstances. In case the delegate of the Minister of Citizenship and Immigration of Canada is of the opinion that such special circumstances exist, the individual will be granted an exemption from visa requirements and allowed to remain in Canada as a permanent resident.

In most cases, the applicant's establishment in Canada, his or her family ties to Canada citizens or permanent residents, interests of a child will be taken into consideration as well as the degree of hardships which the applicant should experience in case he faces deportation from Canada.
