In certain circumstances, a foreign national will be detained by the Canada Border Service Agency. This can happen for a number of reasons, such as non compliance with a set of conditions set out by the CBSA or staying in Canada without proper authorization or even when first arriving in Canada at the airport.


It is strongly recommended that you contact us as soon as you are initially placed under arrest or detained for questioning. You can call us any time day or night.

Initially we will work with proper agency to secure your release as soon as possible. If you are not released, an Hearing will be scheduled for you to appear before a Member of the Immigration Division within the first 48 hours of your detention. We will rep[resent you at your hearing to secure your release. You will not get another Detention Hearing for 7 days after that and every 30 days subsequent to the 7 day detention review.

The Minister's Counsel is present at the Proceedings in order to present a case against the detainee and convince the Decision Maker (in this case a Board Member of the Immigration Division) to continue the detention. Our job will be to convince the Board Member to release the detained person by making a case for her/him.
